Conveyancing Mobile Lawyer Perth

We often get asked to explain what conveyancing is. Here’s a breakdown of the settlement process and how Amadeus Legal can assist you:

One of the essential steps in the settlement process is reviewing the sale contract. Our lawyer will meticulously examine the terms and conditions, ensuring that your interests are protected and there are no hidden surprises. We provide expert guidance, making sure you understand the legal implications and obligations associated with the contract.

Our team conducts a thorough investigation of the property’s title to uncover any encumbrances or restrictions that may impact your ownership rights. This includes searching for existing mortgages, liens, or caveats that need to be addressed before the settlement. Our team has access to comprehensive databases and resources to ensure a comprehensive title search.

Enquiring with local councils and with government departments about rates, taxes and water consumption to determine details of the sewer connection, any outstanding orders and building licences and the amounts to be paid by the seller and the buyer. We will also notify the relevant authorities about the change of ownership.

If any issues arise during the title search or contract review, our lawyer will skillfully negotiate with the other party to find a resolution that aligns with your best interests. We perform due diligence to identify potential risks and advise you on the appropriate course of action. We will also attend to any other legal issues that may arise during the process (we note that any legal advice, outside of the normal conveyancing process, may attract additional cost).

Our lawyer will handle the preparation and lodgment of all necessary documents required for settlement, such as the transfer of ownership, mortgage documents, and settlement statements. We ensure that all legal paperwork is accurate, compliant with the relevant laws and regulations, and submitted within the required timeframes.

If you are the purchaser, we will lodge the contract for duty assessment and arrange for payment of the duty amount on your behalf. We will also pay all fees to the relevant government agencies.

On the settlement day, our lawyer will act as your legal representative during the settlement process. We liaise with the other party’s representatives, ensuring that all necessary documents are exchanged, funds are transferred, and the settlement is successfully completed. Our presence provides peace of mind and ensures that your rights and interests are protected.

Electronic Settlement Process

From 1 May 2018, all eligible property settlements throughout Western Australia must be lodged electronically using PEXA, which stands for Property Exchange Australia. It enables users to lodge documents and complete financial settlements electronically.

Amadeus Legal is a PEXA-certified settlement agent and we offer PEXA settlements for both buying and selling properties in Perth. We have the skills and expertise to guide you through an electronic settlement.
